STATEMENT OF THE CASE
By a second superseding indictment, Indictment No.1:20-cr-00330 (AJN)
(A114),² filed in the United States District Court for the Southern District of New
York on March 29, 2021, Defendant was charged with the following counts: (1)
Conspiracy to Entice Minors to Travel to Engage in Illegal Sex Acts (18 U.S.C.
§2422 and §371); (2) Enticement of a Minor to Travel to Engage in Illegal Sex
Acts (8 U.S.C. §2422 and §2); (3) Conspiracy to Transport Minors with Intent to
Engage in Criminal Sexual Activity (18 U.S.C. 2423(a) and §371); (4)
Transportation of a Minor with Intent to Engage in Criminal Sexual Activity (18
U.S.C. §2423(a)); (5) Sex Trafficking Conspiracy 18 U.S.C. §1591(a) and (b) and
§ 371; (6) Sex Trafficking of a Minor in violation of Title 18, United States Code,
§§1591(a), (b)(2), and 2); and two counts (7) and (8) Perjury (18 USC §1623).³
Defendant proceeded to trial on Counts One through Six. Defendant was
acquitted of Count Two and convicted on the remaining counts.
Prior to sentencing, Defendant moved for a new trial pursuant to Fed. R.
Crim. P. 33 after a juror revealed that he had made materially false statements in
voir dire by which he concealed that he was a child sexual assault victim. The
