ORDER OF DEFAULT AGAINST DEFENDANT SARAH KELLEN
THIS CAUSE is before the Court on Plaintiff’s Motion for Default against Defendant
Sarah Kellen (DE 37), filed June 12, 2009. The Court has carefully reviewed the motion and the
record and is otherwise advised in the premises.
Plaintiff Jane Doe II filed a Complaint against Defendants Epstein and Kellen on March
24, 2009 (DE 1). The Court has reviewed the affidavit of service accompanying Plaintiff’s
motion for default against Kellen and concludes that Plaintiff effected service on Defendant Kellen
in a manner authorized by New York state law. See N.Y.C.P.L.R. § 308(4). Defendant Kellen
has failed to answer or otherwise respond to the complaint. Accordingly, it is hereby
ORDERED AND ADJUDGED as follows:
1. Plaintiff’s Motion for Default against Defendant Sarah Kellen (DE 37) is GRANTED.
