PLEASE TAKE NOTICE THAT, upon the accompanying memorandum of law,

proceedings herein, Defendants JPMorgan Chase & Co., Stephen Burke, Todd Combs, James
Crown, Timothy Flynn, Mellody Hobson, John Kessler, Phebe Novakovic and James Dimon, by
